1. Acceptance of Terms

Welcome to Dreamcatcher. By accessing or using our language learning platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

These Terms constitute a legally binding agreement between you and Dreamcatcher Studio Co. Ltd. ("Dreamcatcher," "we," "us," or "our").

2. Description of Service

Dreamcatcher provides an AI-powered language learning platform that enables users to practice speaking Thai through conversation practice, vocabulary building, and personalized feedback. Our services include:

• AI conversation practice sessions
• Spaced repetition vocabulary review
• Pronunciation feedback and analysis
• Progress tracking and learning analytics
• Additional features as described on our website

3. User Accounts

Account Creation

To access certain features of our platform, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized access or security breach

Account Eligibility

You must be at least 13 years old to create an account. If you are under 18, you represent that you have your parent or guardian's permission to use the service.

4. Subscription Plans and Payments

Free Tier

We offer a free tier with limited features (10 conversations per month). Free accounts may have restricted access to certain features and content.

Paid Subscriptions

Paid subscription plans (Pro and Premium) are billed on a recurring monthly basis. By subscribing, you agree to:

• Pay all fees associated with your chosen plan
• Provide valid payment information
• Authorize automatic renewal unless you cancel
• Pay any applicable taxes

Price Changes

We reserve the right to change our pricing. We will provide at least 30 days' notice of any price increases for existing subscribers. Your continued use of the service after the price change constitutes acceptance of the new pricing.

5. Cancellation and Refunds

You may cancel your subscription at any time through your account settings. Upon cancellation:

• You will retain access to paid features until the end of your current billing period
• No refunds will be issued for partial months
• Your account will revert to the free tier at the end of the billing period

6. User Conduct and Prohibited Activities

You agree not to:

• Use the service for any illegal purpose or in violation of any laws
• Impersonate any person or entity or misrepresent your affiliation

• Use automated systems (bots, scripts) to access the service
• Share your account credentials with others
• Reverse engineer, decompile, or disassemble any part of the service
• Remove, alter, or obscure any proprietary notices
• Use the service to harass, abuse, or harm others

7. Intellectual Property Rights

Our Content

All content, features, and functionality of the service, including but not limited to text, graphics, logos, images, audio, software, and AI models, are owned by Dreamcatcher or our licensors and are protected by intellectual property laws.

Your Content

You retain ownership of any content you create through the service (such as voice recordings and practice data). By using the service, you grant us a limited license to use, store, and process your content solely to provide and improve our services.

9. AI-Generated Content and Disclaimers

Our service uses artificial intelligence to generate conversation practice and feedback. While we strive for accuracy:

• AI responses may occasionally contain errors or inaccuracies
• Feedback and suggestions are educational tools, not professional language instruction
• We do not guarantee specific learning outcomes or fluency levels
• The service is supplemental to, not a replacement for, comprehensive language education

10. Service Availability and Modifications

We strive to provide continuous access to our service, but we do not guarantee uninterrupted availability. We reserve the right to:

• Modify, suspend, or discontinue any aspect of the service
• Perform maintenance and updates
• Change features or functionality
• Impose usage limits or restrictions

We will provide reasonable notice of significant changes when possible.

11. Termination

We may terminate or suspend your account and access to the service immediately, without prior notice or liability, for any reason, including:

• Violation of these Terms
• Fraudulent or illegal activity
• Extended periods of inactivity
• At our sole discretion

Upon termination, your right to use the service will immediately cease. You may also terminate your account at any time through your account settings.

12. Disclaimers and Limitations of Liability

DISCLAIMER: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

LIMITATION OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY LAW, DREAMCATCHER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

13. Indemnification

You agree to indemnify, defend, and hold harmless Dreamcatcher, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the service or violation of these Terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Thailand, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the service shall be resolved through good faith negotiation. If negotiation fails, disputes shall be resolved in the courts of Phuket, Thailand.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the service after any changes constitutes acceptance of the new Terms.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
